1. Who are we?

Lifestyle Monitors is based in the Netherlands and has been developing tools for healthy lifestyle habits and stress prevention since 2010. We are the controller (in GDPR terms: the "data controller") for the processing of your personal data.

2. What data do we collect?

The data we collect depends on how you use our services. We distinguish different contexts:

HLM App (Healthy Lifestyle Monitor)

When you use the free HLM App, we collect:

  • Account data: Email, password (encrypted), account settings
  • Profile data: Name (optional), date of birth (for age range), gender (optional)
  • Health data: Daily measurements (relaxation, stress, energy, sleep, strain), heart rate variability (if you use a heart rate monitor), personal reflections and notes
  • Technical data: Device type, operating system, app version, language settings
  • Usage data: Login times, features used, error messages

Webshop

When you make a purchase in our webshop, we collect:

  • Contact details: Name, email, phone number
  • Shipping data: Address, postcode, city, country
  • Payment data: Payment method (we do not store credit card details – this is handled by our payment provider)
  • Order data: Products, prices, discount codes, order history

External Sales Channels

For purchases through Amazon, distributors, publishers, Google Play or Apple App Store, the privacy policies of those platforms apply. We only receive information necessary for delivery or support.

Communication Channels

When you contact us through various channels, we collect:

  • Email: Email address, name, message content, attachments
  • WhatsApp: Phone number, message content, timestamp
  • LinkedIn, Facebook, Instagram: Profile name, message content, public profile information
  • Personal contact: Name, contact details, conversation notes (only with your consent)

Website

When you visit our website, we collect:

  • Technical data: IP address (anonymised), browser type, pages visited, time of visit
  • Cookies: See section 7 for details on cookies

3. Why do we collect this data?

We only collect data that is necessary for our service. Here are the reasons by type:

For the HLM App

  • Account management: To create and manage your account
  • Service delivery: To provide app functionality (daily measurements, overviews, trends)
  • Improvement: To improve the app and fix bugs
  • Support: To help you with questions or problems

The HLM App is based on the Columbus Catalyst Code approach for sustainable behavioural change.

For Orders

  • Order processing: To process and deliver your order
  • Communication: To keep you informed about your order
  • Customer service: To answer questions about your order
  • Administration: For financial accounting and warranties

For Communication

  • Response: To answer your questions
  • Support: To provide technical or practical assistance
  • Relationship management: To build and maintain a business relationship with you

Legal Basis (GDPR Article 6)

We only process your data on a lawful basis:

  • Contract performance: For use of the app and processing orders
  • Consent: For marketing communications (you can withdraw at any time)
  • Legitimate interest: For improving our services and support
  • Legal obligation: For financial accounting

4. How do we protect your data?

We take the security of your data very seriously and have implemented appropriate technical and organisational measures:

Technical Security

  • Encryption: All data is stored encrypted (AES-256) and transmitted encrypted (TLS/SSL)
  • Passwords: Passwords are hashed and never stored in readable form
  • Dutch servers: Your data is stored on secured servers in the Netherlands (within Europe)
  • Firewalls: Protection against unauthorised access
  • Regular backups: For data recovery in case of disasters
  • Updates: Regular security updates of all systems

Organisational Security

  • Restricted access: Only authorised personnel have access to personal data
  • Confidentiality obligation: All our employees have signed a confidentiality agreement
  • Data processing agreements: With all external parties that process data
  • Privacy by Design: Privacy considerations from the start when developing new features

Note: No system is 100% secure. Although we do everything to protect your data, we cannot guarantee absolute security. Always use a strong, unique password.

5. Who do we share data with?

We never sell your data to third parties. We only share data when necessary for our service:

Sales Channels

  • Amazon: For purchases through Amazon, their terms apply
  • Google Play / Apple App Store: They receive standard information for app purchases
  • Distributors: Share only order information for delivery
  • Publishers: Only information necessary for distribution

Technical Service Providers (Processors)

  • Hosting provider: For hosting our servers (Netherlands, within Europe)
  • Email service: For sending transactional and service emails
  • Payment services: For secure payment processing (e.g. Mollie, Stripe)
  • Analytics: For website statistics (anonymised)

Legal Obligations

We may be required to share data with authorities in case of:

Important guarantee: We have data processing agreements with all external processors that comply with the GDPR. They may only use your data for the agreed purposes and not for their own purposes.

You can request what data we have about you and for what purposes we use it.

Right to Rectification

You can have incorrect or incomplete data corrected. You can often do this yourself in the app or via your account.

Right to Erasure

You can have your complete account and all associated data deleted. After deletion, we cannot recover your data.

Right to Data Portability

You can request your data in a structured, commonly used and machine-readable format. In the HLM App, you can export your data.

Right to Restriction

In certain cases, you can request to restrict the processing of your data.

Right to Object

You can object to the processing of your data based on legitimate interest.

Withdrawal of Consent

If you have given consent for certain processing (such as marketing), you can withdraw this consent at any time.

Do you disagree with how we handle your data? You always have the right to file a complaint with the relevant data protection authority. In the UK, this is the Information Commissioner's Office (ICO). In the Netherlands, this is the Autoriteit Persoonsgegevens (AP).

8. Privacy with HLM Pro

HLM Pro has a unique privacy structure as multiple parties are involved:

The Client (Person with the HLM App)

  • Remains owner of all data
  • Determines which data is shared with the professional
  • Can disconnect at any time
  • Can revoke the professional's access without consequences

The Professional (Coach, Therapist, Trainer)

  • Only gains access to data that the client shares
  • Is themselves controller for the data received
  • Must treat the data confidentially
  • Must have their own privacy policy for clients

Lifestyle Monitors (Platform Provider)

  • Enables secure data sharing
  • Has no insight into the content of shared data
  • Ensures technical security
  • Only processes technical data (who is linked to whom)

Important guarantee for organisations: If you use HLM through your employer or an organisation: your employer never has access to your individual data. Your data remains private unless you yourself link a professional (such as an occupational physician).

9. How long do we store your data?

We do not store your data longer than necessary:

HLM App Data

  • Active account: As long as your account is active
  • Inactive account: 3 years after last activity, then automatic deletion
  • After account deletion: Immediate permanent deletion (no backup)

Orders

  • Order data: 7 years (legal retention requirement)
  • Order communication: 2 years after delivery
  • Warranty claims: During warranty period + 1 year

Communication

  • Support tickets: 2 years after closure
  • General correspondence: 1 year after last contact
  • Marketing consent: Until withdrawal or 3 years of inactivity

10. Changes to this Privacy Policy

We may update this Privacy Policy from time to time, for example due to new legislation or new functionality. The most current version is always available on this page.

For significant changes, we will send you an email or show a notification in the app. We recommend that you visit this page regularly.
